1. Who we are and how to contact us
Spine & Posture Care ("we", "us") operates chiropractic clinics at Level 4, Suite 4.02, 139 Macquarie Street, Sydney NSW 2000 and Level 35, 100 Barangaroo Avenue (Tower One), Sydney NSW 2000. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and by the Health Records and Information Privacy Act 2002 (NSW).

2. Our website
Most people who visit our website are not patients, and most of this policy will not apply to you. This section is the part that does.
We use Google Analytics to understand how our website is used — which pages people visit and how they move through the booking process. This uses cookies, and it means some information about your visit is processed by Google, a company based in the United States. You can turn cookies off in your browser settings.
If you book an appointment online or fill in a form on our site, we collect what you enter so that we can respond to you. If you book, the rest of this policy then applies to you as a patient.
If you download one of our guides, we use the email address you give us to send you that guide and a short series of follow-up emails about the topic. You can unsubscribe from any of them, and the link is in every email.
3. What we collect
Personal information: your name, date of birth, contact details, emergency contact, occupation, Medicare and private health fund details, and payment records.
Health information, which is sensitive information under the Privacy Act and is collected only with your consent and only where reasonably necessary to provide your care: your presenting complaint and history, what you tell your practitioner during consultations, our examination findings, your treatment notes and care plan, imaging and reports, and your appointment history.
4. How we collect it
Most of it comes from you: your intake form, your consultations, and what you tell our reception team. We also receive information about you from others where relevant to your care, such as referring practitioners, radiology providers, and your insurer.
With your consent we record and transcribe consultations so that your notes are accurate. Section 8 explains this.
5. Why we collect it, and who we disclose it to
We use your information to provide and manage your care, to contact you about your appointments and your care, to bill and claim, to meet our record-keeping obligations, and to review our own standards and train our practitioners. Some of these use the providers named in section 7, which means the messages we send you may be stored overseas.
We disclose it to:
- your practitioner and our clinical and reception staff, so far as they need it;
- **Medicare, the Department of Veterans' Affairs, your private health fund, or an insurer or
- another health practitioner where you have asked us to refer you or where it is needed for
- the software providers that run our clinic, who store information on our behalf: our
- anyone else you tell us to, or where the law requires or permits it.
We do not sell your information, and we do not disclose it for advertising.
6. Direct marketing
As our patient we may contact you about your care, our services and clinic news, including a regular newsletter that goes to everyone on our patient list. Who receives what is based on your history with the clinic, including whether you are currently attending. You can opt out at any time by replying to the message, using the unsubscribe link, or telling us, and it will not affect your care.
7. Overseas disclosure
The provider that transcribes our consultation recordings is based in the United States. If you consent to your consultations being recorded, your consultation is disclosed to that provider outside Australia.
You should know that once information is disclosed overseas we may not be able to ensure the recipient handles it in the way the Australian Privacy Principles require, and the recipient may not be subject to Australian privacy law. If you would rather this did not happen, tell your practitioner and we will not record your consultations. Your care is not affected by that choice.
Some of the other companies that store information for us are also overseas. Depending on the service, your contact details and the messages we send you may be held in the United States, France, Germany, Ireland, Brazil or Costa Rica, and our email and file storage provider does not limit the country it stores data in.
Your clinical record itself — your notes, your history, your appointments — is held in our practice management system, and that is stored in Australia. ### 8. Recordings of your consultations
With your consent we record and transcribe consultations so that your practitioner can give you their full attention rather than typing, and so that your notes are as accurate as possible.
We do not keep the audio any longer than we need it for your notes and our own review. The transcript is used for your clinical record and treatment notes. We also review consultations to check our own standards and to help our practitioners keep improving, which is done within the clinic.
You can tell your practitioner at any time if you would rather your consultations were not recorded.
9. How long we keep it
The Health Records and Information Privacy Act (NSW) requires us to keep your health information for at least 7 years from the last time we provided you a service. If we saw you before you turned 18, we keep it until you turn 25. We keep it securely for that period even after you stop attending.
10. Accessing and correcting your information
You can ask to see the information we hold about you, and ask us to correct it if it is wrong. Contact us using the details in section 1. We will respond within a reasonable time. In limited circumstances the law allows us to refuse access, and if we do we will tell you why.
11. Complaints
If you think we have mishandled your information, tell us using the details in section 1 and we will investigate and respond. If you are not satisfied with our response you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, or to the NSW Privacy Commissioner.
